The Peruvian Government will go to the Constitutional Court by decree of the Congress

The Government of Peru will appeal to the Constitutional Court (TC) after the decision of the Congress to ratify a law that increases the pensions of the retired military and police, today informed the prime minister, Mercedes Araóz.

Lima, Nov 22 (EFE) .- The Government of Peru will appeal to the Constitutional Court (TC) after the decision of the Congress to ratify a law that increases the pensions of the military and "We have to go to the Constitutional Court, why? Because we have to defend the constitution," said Mercedes Araóz, Prime Minister. Our duty, and we have to prevent the enactment of laws "considered unconstitutional," Araóz said at a press conference.

The president of Congress, Luis Galarreta, promulgated this week the insistence on a law, rejected by the Executive and proposed by the Fujimorist Popular Force, which ordered that police and military retirees receive an amount equivalent to the active staff, in addition to the pension and the additional benefits that they already have access to.

Araóz remarked today, in this regard, that the law promulgated is unconstitutional because Congress can not approve rules that involve spending initiatives or make changes to the pension system.

"That is expressly prohibited in the Constitution", emphasized.

The Prime Minister clarified that this does not mean that the Executive is against the retirees of the Armed Forces and the Police, so it is evaluated to present a project of law to improve the situation of these pensioners.

According to the Peruvian Executive, the approved law would demand the State an extra expense of 1,250 million soles per year (about 378 million of dollars)

In this regard, the former Minister of Economy Alonso Segura said, in statements quoted today by the newspaper El Comercio, that the standard approved by Congress "is clearly unconstitutional. "

" Congress has no spending initiative, but apparently they think they have it and this complicates not only the 2018 budget, but also future budgets, " alerted.
